1. GENERAL INFORMATION AND DEFINITIONS

These General Conditions of Sale apply to any sale of products or services orderable through the website www.maiwatch.it or any associated mobile or digital applications, in their version valid at the time of the order, and fully govern the contractual relationship between the Seller and the buyer, whether an individual or legal entity. The seller reserves the right to modify these terms and conditions at any time by publishing the updated version on the website.

The products purchased on the website www.maiwatch.it are sold directly by the company Insieme S.r.l., with registered office in Genoa, Via Sestri no. 154 R, VAT number 0139190997.

1.2 Definitions

For the purposes of interpretation and correct application of these General Conditions of Sale, the following definitions apply:

  • “online sales contract”: the contract concluded at a distance using computer means "internet", accessed through the website www.maiwatch.it, concerning the purchase of goods and/or services offered on the site, concluded between the seller, Insieme S.r.l., and the final customer and/or buyer;
  • “seller”: the company Insieme S.r.l.;
  • "customerthe natural or legal person, consumer or professional, who purchases the products and/or services on the website www.maiwatch.it by accepting these General Conditions of Sale;
  • "consumer": the natural person acting for purposes outside any business, commercial, artisanal or professional activity carried out;
  • "professionalthe natural or legal person acting in the exercise of their entrepreneurial, commercial, artisanal or professional activity, or an intermediary thereof;
  • "product/s": the watches and accessories offered for sale on the website www.maiwatch.it.

2. ENTITIES WHO CAN MAKE PURCHASES

In the case of natural persons, only those who have reached the legal age required to enter contracts (eighteen in most countries), have the legal capacity to enter contracts, and use a valid shipping address in the country or countries where we ship may conclude a purchase on the website www.maiwatch.it. Minors, unless otherwise provided by the law in force at the time of concluding the distance contract, do not have the faculty to lawfully enter into a contract and must rely on a parent or legal guardian to place an order on their behalf and will be required to accept these General Conditions of Sale.

2. PRE-CONTRACTUAL INFORMATION OBLIGATIONS

The sale price is indicated for each product in EURO and includes VAT. The price indicated on the website www.maiwatch.it does not include any duties, customs charges, or any other tax or fee applied by the country where the goods or services are delivered. Insieme S.r.l. is not responsible for such customs taxation and is not obliged to verify the respective amounts. The customer therefore has the burden of verifying in advance the amount of such possible charges, which cannot be predetermined. The seller reserves the right to change prices at any time, provided that the applicable price will be the one in force at the time of order confirmation.

All payments are processed through secure and encrypted systems. All transactions are protected by SSL/TLS security protocols. Credit card data are not stored on the seller’s servers but are managed directly by payment providers. The seller reserves the right to request additional documentation to verify the buyer’s identity before proceeding with shipment. Payment data are processed exclusively by authorized payment providers and are not accessible to the seller.

3. PURCHASE PROCEDURE AND CONTRACT CONCLUSION

3.1 Ordering process

The distance contract is considered concluded when the seller sends the order acceptance confirmation via email, containing the order summary with the description of purchased products and the total price including all costs, once the customer has made the payment. In case of non-payment or failed payment, the order will be automatically cancelled.

3.2 Order verification

The seller reserves the right to verify the buyer’s identity and the validity of the payment method, cancel orders in case of obvious errors in price or product characteristics, refuse orders that show anomalies or suspected fraud.

3.3 Temporarily unavailable products

If, after the conclusion of the distance contract, the product or one of the purchased products is temporarily unavailable, the seller grants the customer the option to:

  • wait for the product restock for a maximum period of 30 days from the conclusion of the distance contract;
  • obtain a voucher if the product is no longer available, usable for the purchase of other goods and/or services offered on the website www.maiwatch.it;
  • cancel the order and receive a refund of what was paid.

4. SPEDIZIONE E CONSEGNA

4.1 ModalitĂ  di Spedizione

Le spedizioni vengono effettuate tramite corrieri terzi. Insieme S.r.l. non potrĂ  in alcun caso essere ritenuta responsabili per ritardi nella consegna, danneggiamenti, smarrimento e/o furto dei prodotti acquisti, per cause imputabili in via esclusiva al corriere incaricato della spedizione.

4.2 Delivery times

The indicated delivery times are to be considered estimated and not binding, and start from the order confirmation. Times may vary depending on product availability and destination. The seller commits to promptly communicate any delays.

4.3 Responsibility for delivery

The transfer of travel risk occurs at the time of delivery of the package from the seller to the courier. The seller is not responsible for delays attributable to the courier or to force majeure. The buyer must check the integrity of the package at the time of delivery and immediately report any damage.

4.4 Failed delivery

In case of failed or delayed delivery for reasons attributable to the customer (by way of example and not limited to: wrong address, absence at the time of delivery, refusal of the package), additional reshipment costs will be charged to the customer even if the order did not include delivery charges.

5. RIGHT OF WITHDRAWAL

5.1 Right of withdrawal for consumers

The consumer customer has the right to withdraw from the contract within 14 days from receipt of the product, without having to specify the reason and without incurring costs other than those for shipping for the return.

5.2 How to exercise the withdrawal

To exercise the right of withdrawal, the consumer customer must: 

  • send written communication within 14 days of receipt of the product to the email address on the website www.maiwatch.it; 
  • return the product no later than 14 days from the withdrawal communication.

5.3 Conditions for withdrawal

The purchased product must be returned in its original delivery condition, complete with all accessories, documentation, including the original packaging, without any signs of wear other than those necessary to establish nature, characteristics and functioning. The seller reserves the exclusive right to verify the correct functioning of the returned product.

5.4 Refund

the refund will be made within 14 days of receipt of the returned product, using the same payment method used for the purchase. 

5.5 Exclusions from the right of withdrawal

The right of withdrawal is excluded in the case of purchase of made-to-measure or customized products. the seller also reserves the indisputable right to deny the refund in the case of worn, tampered products, or in the absence of accessories and all components (for example: charging cable, box, strap, buckle).

6. WARRANTY

6.1 Conformity Warranty

The Seller guarantees that the products supplied are in conformity with the contract and free from defects that would render them unsuitable for their intended use or that would appreciably diminish their value. The products sold on the website www.maiwatch.it are covered by a legal conformity warranty of 24 (twenty-four) months in favor of the customer qualifying as a consumer. The lack of conformity must be reported to the seller within 2 (two) months from its discovery, under penalty of forfeiture of the warranty. In the event of a lack of conformity, the consumer has the right, at no cost, to the restoration of the conformity of the goods by means of repair or replacement, or to a proportional reduction of the price or termination of the contract, exclusively in cases where repair or replacement are impossible or excessively burdensome.

The customer, qualifying as a professional, is required to examine the products upon delivery and to report any defects or non-conformities within 8 (eight) days from their discovery, under penalty of forfeiture of the warranty. In any case, the action is time-barred 12 (twelve) months after the date of delivery of the product.

7. LIABILITY AND LIMITATIONS

7.1 Limitations of Liability

The Seller shall not be liable for:

  • damages resulting from improper use of the product;
  • damages caused by normal wear and tear;
  • damages resulting from repairs carried out by unauthorized persons;
  • indirect economic losses or consequential damages;

7.2 Force Majeure

The Seller shall not be liable for non-fulfillment due to causes of force majeure, including but not limited to: natural events, strikes, interruptions of public services, measures by authorities, pandemics, wars, terrorist acts.

8. DISPUTE RESOLUTION

8.1 Applicable Law

The sales contract concluded pursuant to these General Conditions is governed by Italian law. Orders and these General Conditions are governed by Italian law and shall therefore be interpreted accordingly. For any and all disputes relating to the interpretation, execution, and termination of the sales contract concluded pursuant to these General Conditions, the Court of Genoa shall have exclusive jurisdiction. In the event that the customer has acted and concluded the contract as a consumer, for purposes unrelated to any entrepreneurial or professional activity carried out, the court of the place where the customer has their residence or domicile, if located within the territory of the Italian state, shall have jurisdiction, or, at the customer’s choice, the Court of Genoa. Failure to enforce any provision of these terms does not constitute a waiver of the right to enforce it at a later time. Should one or more provisions of these terms and conditions be declared null or ineffective, the validity of the remaining provisions shall not be affected.

The Seller undertakes to respond to requests within 24-48 business hours, or in any case within a reasonable period considering the volume of requests received. Assistance is provided in Italian. Upon request, support can be provided in English.
